Activism by dog owners stopped the Humane Society of the United States (HSUS) freight train in Illinois and the City of Chicago this past week.

 

Congratulations!

 

You did what many people thought was impossible. You stopped HSUS in its tracks in a state that is a must-win battle for the powerful and radical animal rights group, which is pushing two bills that would have a devastating effect on people who raise dogs.

 

Also, in the City of Chicago, where HSUS has political clout at the highest levels, a mandatory spay/neuter ordinance stalled during a committee hearing.

 

However, it would be inaccurate to say that you defeated HSUS. You stopped them. You fought them to a stalemate. You have forced them to back down because they didn’t have the votes to win.

 

But you can also expect a bag of political dirty tricks to emerge in the coming days, and the American Sporting Dog Alliance is urging you to be prepared to continue this fight with renewed vigilance, energy and dedication.

 

Here’s what happened, and what to expect.

 

In the state Senate, SB 139 and SB 53 did not get enough support to pass in committee. SB 139 would have made tail docking and ear cropping into felony animal cruelty offenses, and SB 53 would have imposed irrational and burdensome restrictions on people who raise dogs.

 

Votes were not taken, but the bills’ sponsors saw the handwriting on the wall and chose not to force the issue in the face of certain defeat. Several senators credited numerous letters in opposition from dog owners as being an important factor in changing their positions. The American Sporting Dog Alliance was at the forefront of this effort.

 

However, the bills’ sponsors did not simply allow the legislation to die. Instead, they turned them into what are called “shell bills.” Shell bills are stripped of all language and sent to the Senate floor as an empty document.

 

The senators have until April 3, 2009, to amend new language into the bills, and this deadline can be extended in some cases. This keeps the bills alive, in case the sponsors can find enough support to pass them. If the empty bills are amended at some point, they would be sent back to their Senate committees for reconsideration.

 

However, dog owners were lied to by the sponsor of the House version of the kennel legislation, HB 198. Prior to the hearings, Rep. John A. Fritchey assured dog owners that this legislation was not going to be moved in the House. He said the Senate version would be amended, and then be sent to the House.

 

He lied through his teeth.

 

While the Senate hearings were underway, Fritchey got the House Occupational License Committee to approve the bill and send it to the House floor with a “do pass” recommendation. Debate was limited. It now has had its second reading before the House, and could be voted upon or amended at any time.

 

Fritchey has promised not to attempt to move the bill in the House, but we no longer believe his promises because of the utter dishonesty of his actions on the bill in committee.

 

Our hunch is that he plans to come up with an HSUS-anointed bill to be inserted into the Senate shell bill, while simultaneously gutting the House version and inserting Senate language to avoid sending the bill back to the committee, which gave it a cool reception. We have no evidence that our hunch is correct, but this is a common political dirty trick on controversial legislation.

 

Enter more dirty politics

 

The Senate bills’ sponsors have announced that they intend to amend the shell bills by negotiating changes that will reduce the number of people who are opposed to them, Senate Legislative Analyst Amanda Wallen told the American Sporting Dog Alliance.

 

Wallen said she has been assigned to negotiate possible compromises with various interest groups, including dog owners and the state Department of Agriculture. However, Wallen said the negotiations involve only lobbyists for the various groups. A major job of lobbyists is to cut deals and make compromises. The lobbyists meet next this coming Thursday.

 

Dog owners are being represented by four different lobbyists (one was hired by a local kennel club, one was hired by a private individual, one represents commercial breeders and the fourth one represents the Illinois Federation of Outdoor Resources), even though most dog owners will have no input into any agreements that might be negotiated by the lobbyists. In turn, the HSUS lobbyists and the bills’ sponsors will try to find language that is acceptable enough to some dog owners to reduce opposition, if they can convince the groups and their lobbyists to accept them.

 

These kinds of “divide and conquer” tactics are a hallmark of HSUS. The tactic is to find some people who are willing to accept some of the HSUS positions, or who are willing to sacrifice other dog owners if their own interests are protected.

 

We expect the Federation and Illinois Breeders Association lobbyists to hold firm in their opposition to this legislation, but simply don’t know what the other two lobbyists have been directed to do. We do know that some of these lobbyists have been negotiating directly with HSUS, and this concerns us.

 

The American Sporting Dog Alliance considers the use of lobbyists to be an effective part of communicating with elected officials and as a resource to help develop strategy. However, we are uncomfortable about the use of lobbyists to speak for dog owners because most of us have no input into the process.

 

We believe dog owners are quite capable of speaking for themselves by informing elected officials directly about what they want and don’t want in legislation.

 

No compromise or deal on this legislation can represent the views of more than a small percentage of dog owners.

 

The American Sporting Dog Alliance advocates direct contact with elected officials by people who raise dogs. We urge dog owners to write letters, send faxes, fire off emails and make phone calls to let elected officials know your views. Elected officials care about the views of their constituents, and a lot of letters and phone calls can make a big difference in how they vote.

 

It works. The Illinois senators reported a flood of letters of opposition, and say that this was a key factor in their reluctance to support the bills. Several senators said that the large number of letters from dog owners was a major factor in their reluctance to support this legislation.

 

In addition, the American Sporting Dog Alliance is categorically opposed to any form of compromise on these two destructive pieces of legislation.

 

There is no need for HB 53, as current laws have completely addressed every problem that has occurred in Illinois. Existing state and federal kennel laws already are in place and working well, and Illinois has one of the toughest animal cruelty laws in America. There is no situation that cannot be fully addressed by these laws.

 

Senate Bill 139 cannot be changed in any way that is acceptable to the American Sporting Dog Alliance. It is absurd to call tail docking and ear cropping animal torture or cruelty, and we cannot compromise one inch on this issue. Both procedures are routinely and safely performed by breeders, specialists and veterinarians.

 

It’s not broken. Don’t fix it

 

We have learned that “compromise” language will be inserted into the shell bill for SB 139 as early as the coming week. We received a copy of a letter from Sen. Linda Holmes to a constituent that describes the deal.

 

Holmes’ letter said: “There is greater agreement that if such a bill were to be introduced, it would not seek to make tail docking and ear cropping illegal. At most it will require ear cropping done under veterinarian supervision and tail docking also, if done after the pups are 5 days old (the band method for infant pups would be acceptable). I was in favor of those provisions, but opposed to making it illegal in Illinois to crop ears and dock tails.”

 

Very similar language is written into current Pennsylvania legislation. However, the trick used by HSUS in Pennsylvania was to craft language that is very vague, open to interpretation and places the burden of proof on the owner of a dog. In essence, dog owners would be unconstitutionally forced to prove their innocence to an alleged violation, but are given no way to prove it. It is a classic “Catch 22.”

 

The American Sporting Dog Alliance maintains that any compromise is giving the radical animal rights movement an open door into the lives of good people who own and raise dogs. We cannot and will not accept this.

 

Thus, we are urging dog owners to continue taking action as citizens, by urging the senators to reject any alleged compromise on either bill (see below for contact information). We also are urging dog owners to contact clubs of which they are members and clearly state your opposition to any compromise legislation.

 

The American Sporting Dog Alliance believes that dog owners should go for broke and defeat this bad legislation. It is time for us to stop groveling and fight back.

Must-Win For HSUS

 

Illinois is the top priority for HSUS this year, and its importance to the animal rights group is equivalent to the failed AB 1634 in California last year.

 

Here is why Illinois is critically important to HSUS:

 

  • It is the home state of President Barack Obama. What happens in Illinois will catch the ear of the President and he will pay close attention to the results.

 

  • Many state officials still have a personal line of communication directly to the President, from Obama’s days as a state senator and U.S. Senator representing Illinois. Illinois officials who are aligned with HSUS can speak directly to Obama to influence federal legislation.

 

  • Liberal Democrats hold strong margins of power in Springfield and among the Illinois congressional delegation. This political group is the most important to HSUS, and is seen as a key to passing animal rights legislation. HSUS wants to win big in Illinois to send a message to the rest of the nation. HSUS has hired a full-time state director and an army of lobbyists in Illinois. Thus far, dog owners have frustrated what HSUS thought would be a slam-dunk.

 

  • Sen. Dick Durbin represents Illinois in the U.S. Senate. Durbin is the most important senator for HSUS. He has taken the lead in sponsoring several pieces of HSUS animal rights legislation in Congress, including last year’s notorious efforts to amend the Farm Bill to include home hobby breeders under federal regulation, and the recent PUPS Bill. A victory in Illinois gives Durbin a greater mandate in the U.S. Senate. He also was Obama’s political mentor in the Senate.

 

  • The Chicago ordinance represents a major alliance between HSUS and some of the most important political powerbrokers in Illinois. The key elected and non-elected players in Chicago make or break many Illinois candidates on the local, state and federal level.

 

In that context, dog owners must understand and appreciate the importance of what they accomplished in Illinois this week. You have stalled the HSUS freight train, and you can derail it if you refuse to compromise and continue to take an active role.

 

Chicago

 

Chicago activists pulled off a near miracle by stalling a spay/neuter mandate in committee. The battle is far from over, but it became clear at this week’s hearing that passing the ordinance now is questionable, at best.

 

Alderman Edward Burke, who is the most powerful member of City Council and a cosponsor of the ordinance, told a Chicago reporter before the hearing that he had lined up the 26 votes required to pass the ordinance. Following the hearing, Burke was much less optimistic, but said he believes he still has the votes.

 

After the hearing, however, Burke got a boost when Chicago Mayor Richard Daley told reporters that he supports the ordinance. If there is a bright spot in Daley’s comments, it is that the mayor didn’t sound like he was familiar with many of the issues involved, or much of the evidence that contradicts the rationale for the ordinance.

 

Thus, we are urging dog owners to make a concerted effort to encourage Mayor Daley to change his mind. Education about the issues probably is the key, combined with information that proves the vast majority of Chicagoans oppose the ordinance. Burke has been stung by the complete refutation of all of the alleged rationale for the ordinance, as well as strong opposition from the Chicago Veterinary Medical Association, the Illinois State Veterinary Medical Association and letters of opposition from hundreds of dog owners.

 

Several aldermen reported that they have been besieged by letters, phone calls, faxes and emails in opposition. They openly questioned the ordinance at the hearing and expressed major reservations about it. Clearly, Burke’s support is waning, despite his power and political clout. Constituents’ voices are being heard.

 

The fact that dog owners’ voices are being heard is a tribute to the four Chicagoans who are working closely with the American Sporting Dog Alliance. For more than a year, Michele Smith, Margo Milde, Karen Perry and Ami Moore have dedicated their lives to defeating this ordinance. Each has devoted several hundred hours to the cause of bringing dog owners together in Chicago. Special thanks also goes to radio talk show host Steve Dale, whose reportage on this issue has been exceptional, and to Dr. Shelly Rubin of the Illinois State Veterinary Medical Association and Dr. Shannon Greeley, president of the Chicago Veterinary Medical Association, for their strong and courageous support.

 

Dog owners still need to take a more active role at the hearing when it resumes at a later date, which has not been announced. A reported 87 people signed up to speak in favor of the ordinance, while only 42 people signed up to oppose it. Only a few of the scheduled speakers got a chance to testify this week, before the hearing was postponed.

 

The American Sporting Dog Alliance is urging all Chicago dog owners to continue to contact their aldermen and voice strong opposition to the ordinance.

The National Institute of Canine Experts is confused and dismayed by Oprah Winfrey’s acceptance of PETA’s Person of the Year Award for 2008. By accepting this award, it appears to NICE, The National Institute of Canine Experts, that Oprah Winfrey sends the message that she agrees with PETA’s mission and actions.


Oprah, “Do you support eliminating medical research for American children who suffer from diseases such as cancer and AIDS? PETA does. PETA’s president has said that “even if animal research resulted in a cure for AIDS, we would be against it.” And PETA has repeatedly attacked many well-respected  medical research foundations such as  the March of Dimes, the Pediatric AIDS Foundation, and the American Cancer Society, solely because they support animal-based research. 

 

 

Oprah, “Do you support organizations that kill 90% of their shelter animals?” PETA does just that.   According to government documents, PETA employees have killed more than 19,200 dogs, cats, puppies, and kittens since 1998.

 

In 2005, two PETA employees were charged with 31 felony counts of animal cruelty each, after authorities found them dumping the dead bodies of 18 animals they had just picked up from a North Carolina animal shelter into a Dumpster.

 

 

PETA puts to death over 90 percent of the animals it accepts from members of the public who expect the group to make a reasonable attempt to find them adoptive homes. PETA spends part of its $32 million annual income on a contract with a crematory service to periodically empty hundreds of animal bodies from its large walk-in freezer.

Oprah, “Do you support the elimination, extinction and eradiation of cows, sheep, goats, cats, dogs, birds, goldfish, honey, rubber, wool, cashmere, milk, and cheese from our lives? Ingrid Newkirk has described her group’s overall goal as “total animal liberation.”  This means the complete abolition of meat, milk, cheese, eggs, honey, zoos, aquariums, circuses, wool, leather, fur, silk, hunting, fishing, and pet ownership from American homes.

 

Oprah, “Do you support those who participate in arson and other criminal activities? PETA does. It appears that PETA has provided financial support to convicted arsonists and other violent criminals. From the article, “7 Things That You Didn’t Know About PETA”, it is reported, “ that PETA made a 2001 donation of $1,500 to the North American Earth Liberation Front (ELF), an FBI-certified “domestic terrorist” group responsible for dozens of firebombs and death threats. During the 1990s, PETA paid $70,200 to Rodney Coronado, an Animal Liberation Front (ALF) serial arsonist convicted of burning down a Michigan State University research laboratory. In his sentencing memorandum, a federal prosecutor implicated PETA president Ingrid Newkirk in that crime.”

 

Oprah, “Do you support an organization that spreads misinformation about Jesus Christ and attempts to vilify respected religious practices? PETA does. PETA’s has been reported in having billboards taunt Christians with the message that hogs “died for their sins”  a gross misrepresentation of the life and message of Jesus Christ.

PETA’s “Holocaust on Your Plate” campaign compared the genocide of the Jewish victims of the Nazi Holocaust to our use of chickens and other traditional farm animals. PETA’s anti-religion campaigns include a website that claims—despite any evidence to support their claim—that Jesus Christ was a vegetarian.

 

Oprah, “Why are you associated with an organization that cares more for publicity than the truth?” PETA frequently tolerates celebrity spokespersons that don’t practice what they preach. Many of its celebrity spokesmen and woman eat meat, wear fur and support animal based research.

 

For those of you who adore Oprah as much as we do, we understand your horror and disgust with the facts that we have presented. Everyone can make a mistake, and we are sure that Oprah did by accepting this Award. The National Institute of Canine Experts are asking you to contact Oprah and to ask her to return her award right back to PETA. 

 

And our next questions is, "Why is Wayne Pacelle of HSUS even allowed to appear on your show at all as there is overwhleming evidence that he and his organization  appear go out of their way to kill healthy, innocent puppies."

NICE says Illinois HB 0198, Chole's Bill will create a Canine Killing Field in Illinois

 

Location, State – February 20, 2009 – The National Institute of Canine Experts believe that the proposed Illinois HB 0198, known as Chole's Bill will bring to an end the completely humane and responsible activity of dog breeding in the state of Illinois. Ami Moore, Director of NICE believes it is important for good breeders to continue breeding dogs.     Each of these dogs come with unique traits that perform them perform certain jobs. She says that each dog bred comes with certain characteristics that are as valuable to human welfare and wellness as clean air, organic food and pure water. 

 

If dog breeding is stopped in its present form, our lifestyles in Illinois will be negatively affected because the  food supply chain is going to be affected. These purebred dogs help us raise healthy pigs, chickens and cows in a humane manner all of which will come to an end after Illinois HB 0198 or Chloe’s Bill is passed. For example, the farmers and ranches need to have access to dogs that help them take care of their stock. If they are denied their right to purebred dogs with special skills, they will be forced out of their business-food at our local stores will become extremely expensive.

 

NICE emphasizes that dog breeding is not about building genetically superior dogs, it's all about breeding dogs that have certain special traits that help them perform certain jobs while avoiding genetic problems (using health tests and tracking the bloodlines) at the same time. The bill for example,

requires dogs to be kept in cages and strict sanitation rules would also apply-laws that are so strict most veterinarians could not met them.

 

This law would prevent the puppies from being socialized properly which could increase a dog’s future aggressiveness.  According to Ami Moore, many of the breeders keep the animals in their homes as pets, which is even better. But after the bill is passed, they would need to keep the dogs outside, like livestock in harsh cages.  Even the proper socialization of the puppies with the rest of the pack would not be possible any more under these new laws, says Ami Moore.

 

The most disturbing effect on our lives if HB 0198 passed is that if a breeder had a minor infraction, say rust on a kennel, under this law, all of her dogs could be confiscated and if the infractions were not fixed within seven days the dogs would all have to be killed by a vet. This is a bill that is bad for dogs, bad for people and bad for Illinois. Join the National Institute of Canine Professionals, membership is free, and help us prevent Rep. NICE Comes Out Against Dog Trainers' Certification as Proposed in New York State Legislature

Chicago, IL – Februrary 5, 2009 – The National Institute for Canine Experts

 

(NICE), which has Ami Moore, the world renowned dog behaviorist from Chicago, among its distinguished members, has come out strongly against the proposal of certification of the dog trainers as stated in the bill proposed by New York District 39’s Assemblyman Jose Peralta. The organization (it can be reached at www.nicenow.org ) is instead working on an alternate trainer certification test which can be fair towards the trainers, while emphasizing the professional aspects.

 

The bill that has been initiated in the New York state legislature intends to oblige the dog owners to adhere to the new licensing requirements, which may even end up discouraging people from owning the dogs in the longer term. According to Ami Moore, the bill in its present form may have a negative effect on the dog training professionals and the way they do business. She further says that the bill is also unclear regarding the results that may follow if the dog owners are not adhering to the stipulations, which leaves undue amount of discretion at the level of the enforcing authorities. Even otherwise, she says, there has been enough disagreement in the past over who can be called a dog trainer and what constitutes a trained dog.

 

Dog training has been a market regulated business in which several dog trainers thrive in an equally diverse disciplines under the profession of dog training. Recent times have seen a spurt in the number of dog training institutes, as well as certification authorities and bodies.

 

Ami Moore says that seasoned dog trainers having honed their skills through years of practice and training dogs that must pass rigorous training tests such as French Ring, Obedience Trail Champion and Hunting Dog Test that actually measure a dog trainer's ability to train a dog to an off-leash standard, whereas at other well known certification bodies such as Association of Pet Dog Trainers, the APDT, require minimal hands on dog training hours and a multiple choice test before granting the certificate.

 

Ami Moore says, "Picking a dog trainer is like picking a chef. Do you pick the chef that has been in the kitchen for a short amount of time and has passed a multiple choice test as an indication of his expertise or do you pick the chef that can cook a real meal for you to sit down and eat?

"

Ami Moore says that determination of safe behavior of dog is better alternative compared to determining "obedience quotient" of the dog. On the other hand, the proposed New York legislation is impractical and difficult to implement. NICE says that the present legislation doesn't serve the dog loving people of the state neither does it ensure safe behavior of the dogs, while clamping down on the well meaning dog behavior experts of the state.

Dog Bleeds to Death After "Routine" Microchip Implant Procedure


Grieving owner calls for an end to mandatory microchipping in Los Angeles

 

 

A fluffy bundle of life, love, and enthusiasm named Charlie Brown was
laid to rest last week, the victim of a microchip implant gone horribly
wrong. The long-haired, purebred Chihuahua bled to death in the arms of
his distraught owners, Lori and Ed Ginsberg of Agua Dulce, California,
just hours after undergoing the controversial chipping procedure.

"I wasn't in favor of getting Charlie chipped, but it was the law,"
said Lori Ginsberg, citing a Los Angeles county ordinance that requires all
dog owners to chip their dogs once they reach four months of age. Dog
owners who refuse to comply face a $250 fine for the first offense and
up to six months in jail for continued non-compliance. "This technology
is supposedly so great until it's your animal that dies," she said. "I
can't believe Charlie is gone. I'm just beside myself."

 

Dr. Reid Loken, the board certified veterinarian who performed the
chipping, confirmed on Friday that Charlie died from blood loss
associated with the microchip. He cited "an extreme amount of bleeding"
from the "little hole in the skin where the [microchip implant] needle
went in" as the cause of death. He said he was both saddened and
puzzled by Charlie's death.

 

"I just don't know what happened to him. We put the chip in the back in
the shoulder blades, the standard place where we put them, and there
really aren't any major blood vessels in that area," he said. "I don't
think it went in too deep; it was a pretty routine chipping."

Dr. Loken suspected the needle may have nicked the muscle around the
scapula, causing blood to ooze from the muscle. However, his efforts to
stem the bleeding with pressure bandages were unsuccessful. The
bleeding could not be attributed to a congenital clotting problem, he said,
since Charlie had undergone a neutering and tooth extraction without incident
just weeks before.

 

 

Charlie's owners were devastated by the loss. "Charlie loved to play
and cuddle. He brought so much joy and life to our home," said Lori. "We
loved him and took such good care of him. He meant everything to us."

The Ginsbergs were quick to absolve Dr. Loken of responsibility for
Charlie's death. "He's a great vet and this was not his fault. The real
blame is with the people who forced us to implant our dog against our
better judgment," they said.

 

 

The Ginsbergs plan to petition the Los Angeles County Board of
Supervisors to repeal the mandatory chipping law, and have sought the
help of prominent consumer privacy advocate Dr. Katherine Albrecht.
Albrecht is a Harvard-trained researcher who has authored a definitive
academic paper citing literature that links microchips with cancer in
dogs as well as laboratory animals. She has also authored an
exhaustive, 47-page FAQ on microchip implants.

 

 

Albrecht cites other adverse reactions stemming from microchips in the
past. In one case, a struggling kitten died instantly when a microchip
was accidentally injected into its brain stem.  

 

In another, a cat wasparalyzed when an implant entered its spinal column.

The implants have been widely reported to migrate within animals' bodies, and can cause abscesses and infection.

 

In at least two documented cases, dogs have  developed cancerous

tumors surrounding or adjacent to microchip implants.

"Tragedies like what happened to Charlie Brown are probably more common
than we like to think," said Albrecht. "But it takes courageous people
like the Ginsbergs to come forward and talk about it."

 

 

Albrecht and the Ginsbergs are calling for a repeal of all mandatory
animal chipping laws nationwide, and for the creation of a national
registry to document adverse reactions from the chipping procedure.

"It's horrible to live in a country where your choices are being take
away and you don't get to make decisions about your family and your
life anymore," said Lori Ginsberg. "Politicians should not take away my
right to do what I thought was best for my pet."
